The new Title IX regulations that the US Department of Education Office for Civil Rights (OCR) issued on May 6, 2020 require institutions to train most of the parties involved in their Title IX processes on how to eliminate racial bias in their Title IX program. The Preamble in the new regulations explains why OCR established this requirement by showing how commenters raised concerns about race and racial bias during the Notice of Proposed Rulemaking, OCR’s discussion about those comments, and the changes that OCR made to the proposed regulations based on those comments. There are hundreds of references to race and racial bias in the new regulations. This CLE, in the first hour, reviews those comments, discussion, and changes related to racial bias. The second hour is devoted to conscious compliance strategies that educational institutions and all of those involved in the Title IX process, including the Title IX coordinator, investigators, hearing officers, adjudicators, and appeals officer, can apply to eliminate racial bias in the Title IX process. 2 substantive CLE.
